Terms and Conditions of Service

1. Services Overview
China Medical Tour ("We", "Us") provides medical travel coordination, itinerary planning, and concierge support services in China. We act solely as a Facilitator, connecting international patients with third-party hospitals and specialists.
Important Notice:
- We are not a medical provider and do not provide medical diagnosis, treatment, or clinical advice.
- All medical services are delivered by licensed third-party hospitals and specialists.
- Any medical services contract is between you (the Patient) and the medical provider.
2. Medical & Outcome Disclaimer
Content on our website and in our consulting reports is for informational purposes only.
- No Guarantee of Cure: Medical outcomes vary by individual. We do not guarantee results from any treatment, surgery, or procedure.
- No "Buyer’s Remorse" Refunds: Disagreement with a specialist’s medical opinion after a consultation has been delivered is not a service failure and is not grounds for a refund.
3. Visa & Travel Assistance
While we do not issue government visas, our services include assistance in obtaining medical invitation letters from partner hospitals.
- Disclaimer: Final visa approval is solely at the discretion of the Embassy or Consulate of the People’s Republic of China. We are not liable for delays, cancellations, or losses caused by visa denials.
4. Payment & Refund Policy (Strictly Enforced)
By making a payment, you acknowledge that you have read, understood, and agreed to the following refund logic.
A. General Payment Terms
- Transaction Fees: For client-initiated refunds (for any reason), the refund amount will be calculated net of non-recoverable payment processing fees (approximately 3-5% charged by PayPal/Stripe).
- Currency: All refunds are processed in the original payment currency.
B. Service-Specific Refund Rules
1. Intellectual Services (Consulting / Planning / Reports)
- Status: Delivered → 100% Non-Refundable. Once a digital report or itinerary PDF has been sent to your registered email address, the service is deemed complete.
- Status: In Progress → 50% Refundable.
2. Standardized Medical Packages (Checkups / TCM Wellness)
- Cancellation > 7 Days prior: 90% refund.
- Cancellation 3 - 7 Days prior: 50% refund.
- Cancellation < 48 Hours: No refund.
3. Customized Treatment & Concierge Services (Surgery / Hospitalization)
- Cancellation 30+ Days before arrival: 80% refund of service fees.
- Cancellation 15 - 29 Days before arrival: 50% refund of service fees.
- Cancellation 0 - 14 Days before arrival: 0% refund on service fees (100% non-refundable).
Note: Refunds for third-party costs (hospital/hotel) are strictly subject to the vendor’s own cancellation policies. We will process “pass-through refunds” only after funds are received back from the vendor.
5. User Responsibilities & Conduct
- You agree to provide accurate and complete medical history and passport information.
- You agree to comply with the privacy and safety regulations of our partner hospitals.
- Zero Tolerance Policy: Any verbal abuse, harassment, or threatening behavior toward our on-ground staff (translators, drivers, assistants) will result in immediate termination of services with no refund.
6. Dispute Resolution & Anti-Fraud
- Mandatory Contact: You agree to contact PrimeCare Support ([email protected]) at least 7 business days before initiating any dispute or claim with PayPal, Stripe, or your bank.
- Fraud Warning: Filing a chargeback or dispute after services (or digital reports) have been delivered, or without prior communication, constitutes fraud. We reserve the right to report such activities to immigration authorities and credit bureaus.
7. Governing Law
These Terms and Conditions are governed by the laws of the People’s Republic of China. Any disputes arising under or in connection with these Terms shall be resolved within the jurisdiction where China Medical Tour is registered.
8. Interpretation & Modifications
- Final Interpretation: To the fullest extent permitted by law, China Medical Tour reserves the right of final interpretation regarding these Terms, service content, fee structures, and delivery standards.
- Amendments: We may modify service content and pricing at any time based on market conditions or changes in medical resources. Changes take effect once posted on our website or notified to you.
9. Limitation of Liability
To the fullest extent permitted by law, China Medical Tour shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services.
Our total liability for any claim relating to our services shall not exceed the total service fees paid to us for the specific service giving rise to the claim.
10. Third-Party Services
Third-party providers (hospitals, clinics, hotels, airlines, and payment processors) operate under their own terms and policies. We are not responsible for their acts, omissions, or changes in their policies.
11. Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to government actions, epidemics, natural disasters, travel restrictions, strikes, or network outages.
12. Privacy & Data Use
By using our services, you authorize us to collect and share necessary personal and medical information with partner hospitals and service providers to deliver services. Please review our Privacy Policy for details.
13. Language & Version
This English version is the official version. Any translations are provided for convenience only. If there is any conflict, the English version shall prevail.
